Terms & Conditions
Effective date: May 1, 2026
These Terms & Conditions (the “Terms”) form a binding agreement between you and Bezelio (“Bezelio,” “we,” “us,” or “our”). They govern your access to and use of the Bezelio mobile application (the “App”) and the website at https://bezelio.com (together, the “Services”). By installing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
1. Mandatory consumer rights — what these Terms do not change
If you use the Services as a consumer (i.e. for purposes outside your trade, business, craft or profession), you have rights under the mandatory law of your country of residence — including, in the EU/EEA, Directive (EU) 2019/770 on contracts for the supply of digital content and digital services, Directive 93/13/EEC on unfair contract terms, the Geo-blocking Regulation (EU) 2018/302, and equivalent UK law (including the Consumer Rights Act 2015).
Nothing in these Terms limits or excludes any right you have under mandatory consumer law or under the GDPR / UK GDPR. Where any clause of these Terms conflicts with such mandatory rights, the mandatory rights prevail to the extent of the conflict, and the rest of the Terms continues to apply. In particular, nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.
2. Who we are and how to contact us
The Services are provided by Bezelio, established in Sri Lanka. You can contact us by email at admin@bezelio.com.
3. Eligibility
You must be at least 16 years old (or the lower digital-services age set by your EU Member State, which may be as low as 13) to use the Services. By using the Services, you confirm you have capacity to enter into a binding contract under your local law.
4. Licence to use the App
Subject to your compliance with these Terms, Bezelio grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the App on devices you own or control and to access the Site, for your personal, non-commercial use.
All other rights are reserved. The Services, including software, design, text, graphics, logos and trademarks, are owned by Bezelio or its licensors and are protected by intellectual property laws. You may not remove or alter our notices.
The licence does not restrict your statutory rights, including any rights you may have under Article 6 of Directive 2009/24/EC on the legal protection of computer programs (e.g. to study, observe and test the functioning of the program, or to perform acts of decompilation that are permitted by law).
5. Acceptable use
You agree that you will not, and will not attempt to:
- modify, adapt or create derivative works of the Services beyond what is permitted by mandatory law;
- use the Services in violation of applicable law or to infringe the rights of any third party;
- use the Services to store or transmit material that is unlawful, defamatory, infringing, or otherwise unlawful in your jurisdiction;
- interfere with, disrupt, or attempt to gain unauthorised access to the Services or to systems of any third party;
- resell, sublicense, rent or lease the Services without our prior written consent.
6. Your data and your content
The App stores the information you enter (your “Collection Data”) locally on your device. You retain all rights to your Collection Data. We do not claim ownership of it, nor do we receive it.
You are responsible for the accuracy and lawfulness of your Collection Data, including any photos and third-party information you record, and for keeping backups. We cannot recover Collection Data or backup passwords. Our processing of personal data is described in our Privacy Policy.
7. Free service; future paid features
The App is currently free to download and use. We may, in the future, introduce paid features, subscriptions or in-app purchases. Any such fees will be clearly disclosed before you incur a charge, on a transparent “confirm-to-pay” basis as required by EU consumer law, and are subject to the terms of the relevant store.
8. Right of withdrawal (EU/UK consumers) and digital content
Where you purchase a paid digital service from us as a consumer in the EU/EEA or UK, you generally have a 14-day right of withdrawal under Directive 2011/83/EU (UK: Consumer Contracts Regulations 2013). For digital content / digital services supplied immediately, you may be asked to expressly consent to immediate performance and acknowledge that you lose your right of withdrawal once performance has begun, in accordance with Article 16(m) of Directive 2011/83/EU. We will make any such acknowledgement clear at the time of purchase.
Currently the App is free; no withdrawal right applies because no purchase is made.
9. Conformity of digital content (EU/UK consumers)
If you obtain digital content or a digital service from us as a consumer, we are responsible to you for ensuring it conforms with the contract under Directive (EU) 2019/770 (in the UK, the Consumer Rights Act 2015 as amended). Where it does not conform, you have a right to have the digital content or service brought into conformity, to a proportionate price reduction, or to terminate the contract, subject to the conditions set by that legislation. 10. No professional advice
The Services are provided for personal record-keeping. Bezelio is not a professional watchmaker, appraiser, jeweller, insurer, financial advisor or legal advisor. Information stored in or generated by the Services — including suggested service intervals, accuracy calculations, valuations, warranty timelines and PDF reports — is for your convenience and does not constitute professional advice. You should independently verify any information that is important to you. This clause does not exclude or limit any liability that cannot be excluded under applicable law.
11. Third-party platforms
The App is distributed through third-party platforms (Apple App Store, Google Play). Your use of those platforms is governed by their own terms. The App may interact with components of your device (photo library, file system, biometric sensors, notifications) and may link to third-party services. We are not responsible for the availability or content of third-party platforms or services.
12. Updates and changes to the App
We may release updates to keep the App secure, compatible and functional. Where required under EU/UK law, we will provide functionality and security updates that are necessary to keep the digital content in conformity with the contract for the period prescribed by law. Significant changes that go beyond what is necessary to maintain conformity will be communicated in advance, and where they negatively affect your use of the App you may have a right to terminate without penalty.
13. Disclaimers
Subject to section 1 and section 14, the Services are provided “as is” and “as available.” To the fullest extent permitted by applicable law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that backups, Collection Data or passwords will not be lost or corrupted.
Nothing in this section affects your statutory rights as a consumer, including conformity rights under Directive (EU) 2019/770 or the UK Consumer Rights Act 2015.
14. Limitation of liability
Subject to section 1, and to the maximum extent permitted by applicable law:
- we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages; loss of profits, revenue, goodwill or business opportunity; loss, corruption or unrecoverability of data, backups, Collection Data, photos or passwords; loss of, damage to, or theft of any timepiece or related property; or for any matter that was not reasonably foreseeable at the time you accepted these Terms;
- our aggregate liability for any claim arising out of or relating to the Services or these Terms is limited to the greater of (a) the amount you have paid us for the Services in the 12 months preceding the event giving rise to the claim, or (b) EUR 50.
We do not exclude or limit our liability for: (i) death or personal injury caused by our negligence; (ii) fraud or fraudulent misrepresentation; (iii) any liability arising under mandatory consumer protection law (including Directive (EU) 2019/770 and the Product Liability Directive 85/374/EEC, and equivalent UK law); or (iv) any other liability that cannot be excluded or limited under applicable law.
15. Indemnification (non-consumers only)
If you are not a consumer, you agree to defend, indemnify and hold harmless Bezelio and its officers, directors, employees and agents from and against any claims, liabilities, damages, losses and reasonable expenses (including reasonable legal fees) arising out of or related to (i) your use of the Services; (ii) your Collection Data; (iii) your breach of these Terms; or (iv) your violation of any law or third-party right. This clause does not apply to you to the extent you act as a consumer.
16. Termination
These Terms remain in effect while you use the Services. You may stop using the Services and uninstall the App at any time. We may suspend or terminate access where you materially breach these Terms or where required by law, giving you reasonable notice where possible. Sections that by their nature should survive termination will survive, including licence restrictions, disclaimers, limitations of liability, indemnification and dispute resolution.
17. Governing law and jurisdiction
These Terms are governed by the laws of Sri Lanka, without regard to its conflict-of-laws principles.
If you are a consumer in the European Union, the United Kingdom, Switzerland or another jurisdiction whose mandatory law affords you greater protection: you also benefit from the mandatory provisions of the law of your country of habitual residence (Article 6 of Regulation (EC) No 593/2008 — “Rome I”), and you may bring proceedings against us in the courts of your country of residence. We may bring proceedings against you only in the courts of your country of residence (Article 18 of Regulation (EU) No 1215/2012 — “Brussels I bis”).
For non-consumers, the courts of Sri Lanka have exclusive jurisdiction over any dispute arising out of or in connection with the Services or these Terms.
18. Online dispute resolution (EU consumers)
The European Commission provides an Online Dispute Resolution platform at ec.europa.eu/consumers/odr. We are not currently obliged to, nor do we commit to, participate in alternative dispute resolution before a consumer arbitration board, but we will always try to resolve disputes amicably first — please contact admin@bezelio.com.
19. Apple App Store additional terms
If you obtained the App from the Apple App Store, you acknowledge that these Terms are between you and Bezelio only, not Apple, and that Apple has no obligation to furnish maintenance or support for the App. To the extent these Terms conflict with the Apple Media Services Terms, the Apple Media Services Terms control for App Store users. Apple is a third-party beneficiary of these Terms and may enforce them against you.
20. Changes to these Terms
We may update these Terms. The updated Terms will be posted on this page with a revised effective date. Where changes negatively affect you in a more than minor way, we will notify you in advance and, where required by law, give you the opportunity to terminate without penalty before the changes take effect. Your continued use of the Services after the effective date of an update constitutes acceptance of the updated Terms, subject to applicable law.
21. Miscellaneous
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bezelio regarding the Services. If any provision is held unenforceable, the remaining provisions remain in full force. Our failure to enforce any right is not a waiver. You may not assign these Terms without our prior written consent. We may assign these Terms to an affiliate or in connection with a merger, acquisition or sale of assets, provided your rights under these Terms are not reduced.
